Often, yes. As of October 2026, Georgia has no statewide ADU law, so nothing at the state level overrides recorded covenants or HOA rules. If your neighborhood's declaration limits lots to one single-family dwelling, bans separate rentals or requires architectural approval, those rules can stop or reshape an ADU even where city zoning allows one.
Why can an HOA be stricter than the city?
Zoning is a public rule; covenants are a private agreement recorded against the property. The city approves a permit based on its code and does not enforce your HOA's covenants for it. The association can act on them separately, even after the city has issued a permit.
What covenant language should I look for?
- Single-family use clauses. Language limiting each lot to one single-family residence.
- Outbuilding limits. Rules on detached structures, their size or their placement.
- Rental restrictions. Caps on leasing, minimum lease terms or bans on short-term rentals.
- Architectural review. A requirement to get written approval for any exterior change.
- Amendments. Later changes to the original declaration, which may be recorded separately.
Where do I find my covenants?
They are recorded with the county where the property sits: Fulton, DeKalb or Cobb for most of our service area. Your closing documents may include them, and the association should be able to provide the current declaration, bylaws and design guidelines. Ask for any amendments too.
Did the 2026 state bill address HOAs?
HB 1166, which would have limited local zoning barriers to small ADUs, did not pass in 2026. Because it did not become law, there is no state rule on how ADUs and covenants interact. If a future bill passes, its exact text will decide whether private restrictions are affected.
What if my HOA allows ADUs with approval?
It depends on the guidelines. Many associations that allow outbuildings require matching materials, roof pitch and colors, and set their own setbacks. We read the guidelines you send us, design to them, and prepare the drawings the review committee asks for, alongside the city submittal.
What if the covenants are unclear?
Get a written answer from the association before design starts, and consider having a Georgia real estate attorney review the declaration. We can build to what the city allows, but we cannot resolve a covenant dispute, and it is far cheaper to settle it before construction.
