Small backyard home (ADU)

A detached ADU is a separate small house on the same parcel as your home. In the City of Atlanta it is, as of October 2026, the only ADU form the zoning code allows by right, and only in certain districts. It costs more than a conversion because the foundation, frame and roof are all new.

Which Atlanta lots can have a detached ADU?

According to the Department of City Planning, detached ADUs are allowed by right in the R-4, R-4A and R-5 residential districts, and in some special public interest (SPI) and historic districts. The large-lot districts R-1 through R-3 are not part of that list. Your district is on the city's zoning map, and we confirm it for your parcel during the lot check.

How big and how tall can it be?

City Planning lists the current detached ADU limits as 750 sq ft and 20 feet in height, as of October 2026. A third-party summary of Atlanta's code (Steadily, updated October 2026) adds that the house and ADU together cannot cover more than 55% of the lot and the ADU cannot take up more than 25% of the rear yard. We check those numbers against the code for your district before we draw anything.

Are those limits about to change?

Possibly. City Planning has published a proposal that would raise the detached ADU size cap to 1,000 sq ft and the height cap to 24 feet, add the R-4B district, set 4-foot side and rear setbacks in R-4, R-4A and R-4B, and count only conditioned space toward the size limit. The city labels it a proposed policy. Separately, the city's draft rewrite of its whole zoning ordinance was held in committee in September 2026 for revisions. Until something is adopted, we design to the code in force.

Is owner occupancy required in Atlanta?

The City of Atlanta does not require owner occupancy for an ADU, according to the Steadily summary, so both the house and the unit can be rented long term. Short-term rentals fall under a separate city ordinance with its own registration rules. Nearby Decatur is different: it does require the owner to live on site. See ADUs in Decatur.

How much does a detached ADU cost around Atlanta?

One 2026 Georgia cost guide (costtobuildhouse.com) puts a mid-range 600 sq ft detached unit in metro Atlanta at about $130,000 to $180,000, with basic builds lower and high-end builds higher. Angi's national range for new detached ADUs is about $110,000 to $285,000. Sewer and water runs to the back of the lot, an electrical service upgrade and tree work are common extras. More detail is in the Atlanta cost guide.

What about the trees?

Atlanta has a tree protection ordinance, and many intown back yards have large hardwoods. Removing or building near a protected tree can require a permit and replacement or fees, so tree location often decides where a cottage can sit. We map the trees at the site visit and plan the footprint around them where we can.

What else shapes a detached ADU here?

  • Rear-yard depth. Many older intown lots are narrow and deep, which suits a cottage at the back.
  • Slope. Rolling lots may need a stepped foundation or a short retaining wall.
  • Sewer depth. If the sewer line sits higher than the new unit, a pump may be needed.
  • Historic districts. Design review can apply to what the unit looks like.
  • HOA covenants. Private deed restrictions can be stricter than zoning. See can an HOA block an ADU?
